Tax Regulatory

Recent successes include IRS guidance promulgated in 2007 overturning an IRS position adversely affecting insurers that own life insurance, IRS guidance clarifying the tax treatment of international shipping income, and the initiation of an IRS project providing industry-favorable guidance permitting modifications of commercial mortgages held by REMICs.

We have practiced before the United States Tax Court, the United States Bankruptcy Court for the Northern District of Ohio, the United States Bankruptcy Court for the Northern District of Texas, the Maryland Court of Appeals, the Ohio Board of Tax Appeals, and the Supreme Court of Ohio. We are members of the Ohio Bar Association, the District of Columbia Bar Association, the Maryland State Bar Association and the State Bar of Texas.

Administrative Law
The Federal Policy Group has extensive experience working with the federal regulatory process and Administrative Procedure Act (“APA”). The Federal Policy Group’s directors have strong backgrounds in working at all stages of the regulatory process, including working with executive branch agencies in developing policies prior to formal promulgation as regulations, preparing detailed written comments on proposed regulations, and successfully challenging final regulations in federal court under the APA. Among recent achievements by the Federal Policy Group and its directors in this area are successfully advocating the withdrawal of anti-competitive provisions in Federal Reserve Board proposed mortgage regulations which were omitted from the final regulations; successfully advocating provisions in Federal Trade Commission proposed marketing regulations which preserved legitimate direct marketing practices; and providing key litigation support to a successful effort to overturn Department of Housing and Urban Development regulations which would have impeded assistance to low and moderate income home buyers.
